Verbatim Report of Plenary Proceedings: Presentation of Draft Bill-Chapter Eleven, Land and Property Rights
This report documents discussions on the presentation of chapter 11 of the draft bill dealing with land and property rights. It is important to note that this chapter- together with chapter 12 and 13- is also a response to the fundamental concern of how to hold, manage and control Kenya´s Public Resources. It begins by looking at the historical, cultural and social significance of land. Noting that the issue of land ownership has, historically, been a contentious issue in every society, the paper emphasises on the need for the constitutional review process to deal with the question decisively. Among the land related subjects raised and addressed in the paper are; the issue of land privatisation, individualisation, community ownership, land degredation, inconsistent and confusing procedures for allocating, distributing and managing land, land litigation questions etc.
