Substate Constitutions in Fragile and Conflict-affected Setting
တိုင်းဒေသကြီး/ပြည်နယ်အဆင့် ဖွဲ့စည်းပုံအခြေခံဥပဒေများသည် အခြားသော တိုင်းဒေသကြီး/ပြည်နယ် ဥပဒေများအပေါ် လွှမ်းမိုးပြီး တိုင်းဒေသကြီး/ပြည်နယ်အဆင့်တွင် နိုင်ငံရေးအာဏာကို ကန့်သတ်ခြင်း၊ စုဖွဲ့ခြင်းများ ဆောင်ရွက်သည့် စာဖြင့်ရေးသားထားသော ဥပဒေအစီအမံများ ဖြစ်သည်ဟု ယေဘုယျ နားလည်သဘောပေါက်ကြပါသည်။ တိုင်းဒေသကြီး/ပြည်နယ်အဆင့် ဖွဲ့စည်းပုံအခြေခံဥပဒေများ၏ မူလပထမ ရည်မှန်းချက်များမှာ တိုင်းဒေသကြီး/ပြည်နယ်၏ အုပ်ချုပ်မှုစနစ်ကို အတိအလင်း သတ်မှတ်ရန်ဖြစ်ပြီး တိုင်းဒေသကြီး/ပြည်နယ်၏ ပိုင်နက်နယ်မြေ အတွင်း နိုင်ငံသားများ၏ အခွင့်အရေးများကို ပြဋ္ဌာန်းပေးလေ့ ရှိပါသည်။ တိုင်းဒေသကြီး/ပြည်နယ် အဆင့် နိုင်ငံရေးအသိုက်အဝန်းကို သတ်မှတ်ခြင်း၊ ကိုယ်ပိုင်စရိုက်လက္ခဏာကို သတ်မှတ်ပြဋ္ဌာန်း ခြင်းများလည်း ရှိပါသည်။ တဖန် တိုင်းဒေသကြီး/ပြည်နယ်များကို နိုင်ငံတော်တွင် စုဖွဲ့ပါဝင်သည့် နယ်မြေဒေသအလိုက် သတ်မှတ်ထားသော အစိတ်အပိုင်းများအဖြစ်လည်း သတ်မှတ်နိုင်ပါသည်။
ဤမူဝါဒစာတမ်းတွင် ဖက်ဒရယ်နိုင်ငံများနှင့် တစ်ပြည်ထောင်နိုင်ငံများ (သို့မဟုတ် ဖက်ဒရယ် စနစ်ကို ရောစပ်ကျင့်သုံးသော နိုင်ငံများ) ရှိ ထိလွယ်ရှလွယ် အခြေအနေများနှင့် ပဋိပက္ခသက် ရောက်မှုရှိသည့် နယ်မြေဒေသများတွင် စစ်အေးတိုက်ပွဲပြီးနောက် ၁၉၉၁ ခုနှစ်မှ စတင်၍ ပြဋ္ဌာန်း ထားရှိကြသည့် တိုင်းဒေသကြီး/ပြည်နယ်အဆင့် ဖွဲ့စည်းပုံအခြေခံဥပဒေများကို လေ့လာဖော်ပြ ထားပါသည်။ ထိလွယ်ရှလွယ် အခြေအနေများနှင့် ပဋိပက္ခသက်ရောက်မှုရှိသည့် နယ်မြေဒေသ များတွင် တိုင်းဒေသကြီး/ပြည်နယ်အဆင့် ဖွဲ့စည်းပုံအခြေခံဥပဒေများကို ရေးဆွဲပြဋ္ဌာန်းသည့် လုပ်ငန်းစဉ်၊ စီစဉ်ရေးဆွဲပုံတို့နှင့် စပ်လျဉ်း၍လည်းကောင်း၊ ပိုမိုကျယ်ပြန့်သော နိုင်ငံရေး ဖြေရှင်း ချက်နှင့် ငြိမ်းချမ်းရေးတည်ဆောက်သည့် လုပ်ငန်းစဉ်တွင် တိုင်းဒေသကြီး/ပြည်နယ်အဆင့် ဖွဲ့စည်းပုံအခြေခံဥပဒေများ၏ ပိုမိုကျယ်ပြန့်သော အခန်းကဏ္ဍတို့နှင့် စပ်လျဉ်း၍လည်းကောင်း၊ မူဝါဒ စာအုပ်စာတမ်းများ၊ ပညာရပ်စာအုပ်စာတမ်းများ၏ လစ်ဟာချက်များကို ဖြည့်ဆည်းပေးရန် ရည်ရွယ်ပါသည်။
Substate constitutions are broadly understood as written legal instruments that limit and structure political power at the substate level, with legal supremacy regarding other substate laws.
Their primary goals are to define the specific governance system of the substate entity, and often to codify citizen rights within its territory. They may also serve to delineate the political community and identity at the substate level. Substate entities, in turn, can be defined as territorially delineated constitutive parts of a country or state.
This Policy Paper examines substate constitutions in fragile and conflict-affected settings—in both federal and unitary (or hybrid) states—adopted after the end of the Cold War starting in 1991. It aims to fill a significant gap in the policy and academic literatures regarding the process and design of substate constitutions in fragile and conflict-affected settings, and their role in the broader political-settlement and peacebuilding process.
