Call for papers for the IACL conference on “The relationship between democracy and systems of government” in Baghdad, 19-20 January 2024.

Conference theme

Against the backdrop of recent challenges that democratic systems have faced in different parts of the world, this conference will focus on the evolving relationship between democracy and systems of government.  In particular, the conference will focus on how democratic institutions have performed when faced with recent challenges, and what can be learned from recent trends.  The conference will explore a number of themes, including the following:

  1. Many if not all constitutions include arrangements that control against majority rule (including for example constitutional courts that have the authority to strike down legislation).  This has long been an accepted aspect of democracy.  Today, the relationship between rights, systems of government and institutional arrangements is evolving because of the emergence of populism, as well as other challenges.[1]  Examples can range from weakening checks and balances and the curtailing of basic rights.  Participants will be encouraged to examine how this relationship is evolving and what impact it is likely to have on democracy. 
  2. Faced with these challenges and evolving circumstances, participants will be encouraged to examine whether certain systems of government exhibit greater resilience in the face of populist movements, and whether specific constitutional arrangements can effectively counteract populist tendencies while upholding democratic values.  Participants will also be involved to explore the role that populism is playing in upholding illiberal or undemocratic states and in preventing reform (for example in constitutionally captured states).
  3. The evolving nature of judicial institutions and their pivotal contribution to the overall health and vitality of democratic systems. Participants will be encouraged to closely examine the role played by courts in upholding the principles of democracy and combating corruption. Discussions will center around the effectiveness of constitutional frameworks, separation of powers, and accountability mechanisms in empowering courts to act as guardians of the rule of law, ensuring transparency, accountability, and the fair administration of justice.
  4. How systems of government are evolving or should evolve in response to the changing role of political parties. With a focus on both established and emerging democracies, participants will examine the challenges posed by shifting political landscapes, the influence of new political actors, and the potential reforms necessary to enhance the functioning of democratic institutions (including for example the regulation of political parties).

Conference venue

The conference will be organised in Baghdad and will take place at the Rotana Hotel, in central Baghdad.  The conference will be the first international conference focusing on comparative constitutional law for many years to be held in Iraq. 

Eligibility and submissions

The conveners encourage submissions from:

  1. All interested scholars, from all parts of the world;
  2. Both PhD candidates and young scholars (post-docs; research fellows, assistant professors…) at the early stage of their academic careers (within 7 years from the accomplishment of their PhD); and
  3. Scholars from Iraq, from the Arab region and from other global south countries. 

To submit an abstract

  1. Interested scholars are invited to submit a CV and an abstract no longer than 500 words by 1 September 2023 to [email protected] (please use “Call for papers - The relationship between democracy and systems of government” as the subject line of your e-mail).
  2. Abstracts and papers must relate to the conference’s general theme.  Abstracts and papers may focus on the theoretical aspects of the questions set out above and may focus on any region or country or combination of countries.  Abstracts may be submitted in Arabic, English or French. 
  3. Applicants will be notified by 1 October 2023.
  4. Full drafts of papers must be submitted no later than 1 December 2023. Papers should be no longer than 10,000 words (footnotes included).

Conference language

The conference language will be Arabic, English and French. 

Publication

Papers presented at the conference will be considered for publication in an edited volume.  

Registration, travel and accommodation

There is no cost to participate in the conference.  Funding will be available to cover some participants’ travel and accommodation costs, especially from the Global South, according to the conveners’ rules.  Participants who wish to do so may apply for funding.  Funding will be allocated by the organisers on a needs basis.  In any case, funding is not guaranteed.  Instructions on how to apply for funding will be communicated to participants after 1 September 2023.

موضوع المؤتمر

انطلاقاً من التحديات الأخيرة التي تواجهها الأنظمة الديمقراطية في مناطق مختلفة من العالم، سيركز هذا المؤتمر على العلاقة المتطورة بين الديمقراطية وأنظمة الحكم. وسينصب التركيز بشكل خاص على جودة أداء المؤسسات الديمقراطية في مواجهة التحديات الأخيرة، وما يمكن تعلمه من الاتجاهات الحديثة. سوف يتناول المؤتمر عدداً من المحاور، بينها:

  1. تضم اغلب  الدساتير، إن لم تكن جميعها، تنظيما لحكم الأغلبية (كالمحاكم الدستورية التي تمتلك سلطة إلغاء التشريعات على سبيل المثال). ولطالما كان هذا جانباً مقبولا من الديمقراطية. واليوم، تشهد العلاقة بين الحقوق وأنظمة الحكم والترتيبات المؤسسية تطورات مستمرة بسبب ظهور النزعة الشعبوية، وغيرها من التحديات[1]. والأمثلة كثيرة، من إضعاف الضوابط والتوازنات وصولاً إلى تقييد الحقوق الأساسية. سيتم تشجيع المشاركين على دراسة آليات تطور هذه العلاقة وآثارها المحتملة على الديمقراطية.
  2. أمام هذه التحديات والظروف المتطورة، سيتم تشجيع المشاركين على دراسة ما أن هل تُظهر أنظمة حكم معينة قدرة أكبر في مواجهة الحركات الشعبوية، وهل بإمكان ترتيبات دستورية محددة أن تتصدى بفعالية للميول الشعبوية وتحافظ في الوقت نفسه على القيم الديمقراطية. سيُدعى المشاركون أيضاً إلى دراسة دور الشعبوية اليوم في دعم الدول غير الليبرالية أو غير الديمقراطية وفي منع الإصلاحات (مثلا"، في الدول التي تحكمها بشكل دستوري).
  3. الطبيعة المتطورة للمؤسسات القضائية ودورها المحوري في الحفاظ على صحة الأنظمة الديمقراطية وحيويتها. سيُدعى المشاركون إلى إجراء دراسة دقيقة لدور المحاكم في دعم مبادئ الديمقراطية ومكافحة الفساد. ستتمحور المناقشات حول فعالية الأطر الدستورية، وفصل السلطات، وآليات المساءلة في تمكين المحاكم من العمل حامية لسيادة القانون، وضمان الشفافية والمساءلة والإدارة النزيهة للعدالة.
  4. كيف تتطور أنظمة الحكم أو كيف ينبغي أن تتطور استجابة للدور المتغير للأحزاب السياسية. وبالتركيز على الديمقراطيات الراسخة والديمقراطيات الناشئة على السواء، سيقوم المشاركون بدراسة التحديات التي تفرضها تحولات المشهد السياسي، وتأثير الأطراف السياسية الجديدة، والإصلاحات المحتملة الضرورية لتحسين عمل المؤسسات الديمقراطية (بما في ذلك تنظيم عمل الأحزاب السياسية) .

مكان المؤتمر

ينعقد المؤتمر في فندق روتانا وسط بغداد. وهو يمثل أول مؤتمر عالمي يركز على القانون الدستوري المقارن وينعقد في العراق منذ سنوات عديدة.

شروط الحضور وتقديم الأوراق

يدعو المنظمون:

  1. الباحثين المهتمين من مختلف بلدان العالم؛
  2. مرشحي الدكتوراه والباحثين الشباب (حملة الدكتوراه، والزملاء الباحثين، والأساتذة المساعدين في الجامعات وغيرهم) في المرحلة الأولى من حياتهم المهنية الأكاديمية (وفي غضون سبع سنوات من حصولهم على الدكتوراه)؛
  3. الباحثين من العراق والبلدان العربية ومن دول الجنوب الأخرى.

يتطلب إرسال ملخص عن البحث/الدراسة

  1. على الباحثين المهتمين إرسال سيرة ذاتية وملخص لبحثهم لا يزيد عن 500 كلمة في موعد أقصاه 1 أيلول/سبتمبر 2023 على البريد الإلكتروني [email protected] (يرجى وضع عبارة "دعوة لتقديم أوراق – العلاقة بين الديمقراطية وأنظمة الحكم" في خانة الموضوع).
  2. يجب أن تناقش الملخصات والأوراق الموضوع العام للمؤتمر. بإمكان الملخصات والأوراق التركيز على الجوانب النظرية للقضايا المذكورة أعلاه، كما يمكنها أن تركز على أي منطقة أو بلد أو مجموعة من البلدان. يمكن تقديم الملخصات باللغة العربية أو الإنكليزية أو الفرنسية.
  3. سيتم إخطار المتقدمين بتاريخ 1 تشرين الأول/أكتوبر 2023.
  4. يجب تقديم النصوص الكاملة للأوراق في موعد أقصاه 1 كانون الأول/ديسمبر 2023. ويجب ألا يزيد طول الورقة عن 10,000 كلمة (بما فيها الحواشي السفلية).

لغة المؤتمر

اللغات المستخدمة في المؤتمر هي العربية والإنكليزية والفرنسية.

النشر

سيتم النظر في نشر الأوراق المقدمة في المؤتمر ضمن مجلد بعد تحريرها.

التسجيل والسفر والإقامة

لا يوجد أية رسوم على المشاركة في المؤتمر. وهناك تمويل يغطي تكاليف سفر وإقامة بعض المشاركين، خاصة من بلدان الجنوب، ووفقاً لقواعد المنظمين. ويمكن للمشاركين الراغبين التقدم بطلب للحصول على هذا التمويل. سيقدم المنظمون التمويل تبعاً للاحتياجات. ولكنه ليس مضموناً في جميع الحالات. ستُرسل تعليمات بشأن إجراءات طلب التمويل إلى المشاركين بعد 1 أيلول/سبتمبر 2023.
