Submission by African National Congress (ANC)

The submission by ANC concerns administrative justice, access to courts and rights of detained, arrested and accused persons. The document includes content and application of the rights as well as their formulation. ANC suggests that the formulation in the Interim Constitution regarding administrative justice should be amended to make it subject to "necessary practicalities of governance". They further suggest re-wording in simple language of the right of access to court. In addition to the rights of detained, arrested and accused persons provided for in the Interim Constitution the ANC believes that the right to have proceedings recorded should be included.
