Parliamentary immunity has been lifted for MP Abdulla Al Rumaihi during Parliament’s five-month recess, allowing the possibility of criminal proceedings to be pursued against him. [ . . . ] Under Article 89(c) of the Constitution and Article 185 of the Parliament’s internal regulations, permission from the Speaker is required to initiate criminal proceedings against an MP outside the parliamentary session.
If the House or its Speaker fails to issue a decision on a request for permission within one month of receiving it, permission is deemed to have been granted under the applicable provisions.
The lifting of immunity does not constitute a finding of guilt or a conviction.
It removes the applicable parliamentary procedural protection, allowing the relevant legal proceedings to take their course in accordance with the law.
