The Constitutional Court has declared unconstitutional a National Assembly resolution requiring the Council of Ministers to submit legislation ratifying Bulgaria's accession, as a founding member, to the Charter of the Board of Peace established at the initiative of the United States, the Court said in a press release on Thursday.
All 12 Constitutional Court judges took part in the proceedings, and the ruling was adopted unanimously. The case was initiated at the request of the Council of Ministers, with Judge Galina Toneva serving as rapporteur.
The Court reiterated its established case law that, under the constitutional principle of the separation of powers, Parliament cannot use resolutions to interfere with the constitutional powers of other state institutions or intervene without limitation in executive functions.
